These Terms & Conditions apply to all services provided by Genesis Technologies (“we”, “us”), a business registered in India, to you (“the customer”). By submitting a project request or placing an order you agree to these terms.
Eligibility
You must be at least 18 years old and able to enter into a binding contract to place an order. If you order on behalf of a company, you confirm that you are authorised to do so. We serve customers in India and internationally.
1. Service scope
We provide custom software development services, including websites, web applications, APIs, payment integrations, WordPress development, bots and automation. The scope of each order is defined by the service description, your submitted requirements and any written quotation we provide. Work outside that scope is not included unless agreed in writing.
2. Customer requirements
You are responsible for providing accurate, complete requirements and any materials needed (access credentials, API documentation, content, designs). Delays or inaccuracies in the information provided may affect timelines and pricing.
3. Development timelines
Timelines are estimates given in good faith and begin once the scope is confirmed, required access is provided and, where applicable, payment is verified. Timelines may change if requirements change or third-party dependencies are unavailable.
On-time delivery guarantee: if we do not deliver the agreed scope within the agreed delivery time, you are entitled to a 100% refund of the amount paid for that project, as described in our Refund Policy.
4. Payment
Prices shown on the website are starting prices. The final price is confirmed before development. Payment terms are described in our Payment Policy. Development begins only after payment is verified, unless otherwise agreed in writing.
5. Project changes
Change requests after the scope is agreed are reviewed and may require additional time and cost. Changes are only carried out after you approve any revised price or timeline.
6. Third-party services
Many projects rely on third-party platforms such as payment gateways, hosting, APIs, WordPress plugins or messaging services. We are not responsible for the availability, pricing, policies or approval decisions of those third parties. Merchant account approval is subject to each payment provider's own KYC, verification and compliance requirements.
7. API dependencies
Integrations are built against the API documentation available at the time of development. If a provider changes, limits or discontinues its API after delivery, required updates are treated as new work or support.
8. Intellectual property
Upon full payment, you receive ownership of, or a licence to use, the custom code developed specifically for your project, as stated in the quotation. Third-party libraries, frameworks and plugins remain subject to their own licences. We may retain and reuse general know-how, tools and non-project-specific code.
9. Customer responsibilities
- Ensuring you have the right to use any content, credentials, data and third-party services you provide.
- Keeping backups of your existing website, database and files before changes are deployed.
- Complying with laws and platform policies applicable to your business and use of the delivered software.
- Not using our services for unlawful, fraudulent or prohibited activities.
10. Cancellation
You may cancel an order by contacting us. How a cancellation is handled depends on the stage of the project, as described in our Refund Policy. We may cancel an order if requirements cannot be delivered, required access is not provided within a reasonable time, or the project would breach these terms or applicable law.
11. Refunds
Refunds are handled according to our Refund Policy.
12. Support
We provide technical support for issues related to the delivered scope for the period stated in your order or quotation. Support does not cover new features, changes caused by third-party updates, or issues caused by modifications made by others.
13. Limitation of liability
To the extent permitted by law, our total liability for any claim relating to a project is limited to the amount you paid for that project. We are not liable for indirect or consequential losses, loss of profits, data loss or business interruption. Nothing in these terms limits liability that cannot be limited by law.
14. Prices and taxes
Prices are shown in US Dollars (USD) unless stated otherwise on your order. For customers in India, applicable GST is charged as per Indian tax law and shown on the invoice. For customers outside India, services are supplied as an export of services; any local taxes, duties or bank charges in your country are your responsibility.
15. Governing law and jurisdiction
These terms are governed by the laws of India. Any dispute will first be addressed through good-faith discussion; if unresolved, it will be subject to the exclusive jurisdiction of the courts of Uttar Pradesh, India, without prejudice to any mandatory consumer-protection rights you have in your own country.
16. Changes to these terms
We may update these terms from time to time. The version in force when you placed your order applies to that order.
